In a series of articles, Rieppel (2005, Biol. Philos. 20:465–487; 2006a, Cladistics 22:186–197; 2006b, Systematist 26:5–9), Keller et al. (2003, Bot. Rev. 69:93–110), and Nixon and Carpenter (2000, Cladistics 16:298–318) criticize the philosophical foundations of the PhyloCode. They argue that species and higher taxa are not individuals, and they reject the view that taxon names are rigid designators. Furthermore, they charge supporters of the individuality thesis and rigid designator theory with assuming essentialism, committing logical inconsistencies, and offering proposals that render (...) taxonomy untestable. These charges are unsound. Such charges turn on confusions over rigid designator theory and the distinction between kinds and individuals. In addition, Rieppel’s, Keller et al.’s, and Nixon and Carpenter’s proposed alternatives are no better and have their own problems. The spectre of the repugnant conclusion and the search for a population axiology that avoids it has endured as a focus of population ethics. This is in part because the repugnant conclusion is often interpreted as a defining problem for totalism, while the implications of averagism and related views are taken to illustrate the theoretical cost of avoiding the repugnant conclusion. However, we show that this interpretation cannot be sustained unless one focuses only on a special case of the repugnant (...) conclusion: namely, the subset of instances of the repugnant conclusion where there is no portion of the population unaffected by the choice between population outcomes (as in Derek Parfit’s original illustration). To avoid an inappropriate focus on only this proper subset of instances of the repugnant conclusion, we formulate a general characterization of the repugnant conclusion. We then prove formally that all leading welfarist axiologies imply this conclusion, including averagism and Ng’s Theory X0 , including probabilistic and ‘very repugnant’ variants that involve the addition of negative lives. We then prove that the full range of axiologies considered by population ethics each imply an extended version of the repugnant conclusion, including axiologies that are incomplete, intransitive, rank-dependent, person-affecting, and/or pluralist. The upshot is that the repugnant conclusion does not ultimately tell against any approach to axiology, and the methodological requirement to avoid the repugnant conclusion should be dropped from population axiology. This paper offers a new way to make sense of disagreement expansion from a polylogical perspective by incorporating various places in addition to players and positions into the analysis. The concepts build on prior implicit ideas about disagreement space by suggesting how to more fully account for argumentative context, and its construction, in large-scale complex controversies. As a basis for our polylogical analysis, we use a New York Times news story reporting on an oil train explosion—a significant point in the (...) broader controversy over producing oil and gas via hydraulic fracturing. This study investigates how dispute-mediators handle impasse in the re-negotiation of divorce decrees by divorced couples. Three sources of impasse and three strategies for handling impasse are identified based on analysis of mediation transcripts. The concern here lies not so much in the disputant's arguments but in the discussion procedures dispute-mediators use to craft the disputant's argumentation into a tool to solve conflict. Their moves are understood here as a practice of reconstructing argumentative discourse that is neither naïve nor critical (...) but reconstruction as design. Mediator's reconstruction reveals a type of communication work in contemporary societies involved in the crafting of forums and formats that mediate argumentative communication. This work is often invisible and strategic which makes its interpretation, judgment, and development a challenge for pragma-dialectical theory. How reconstruction as design can be understood is discussed by building on prior pragma-dialectical theory and research. (shrink)

Formal arguments have proven that avoiding the Repugnant Conclusion is impossible without rejecting one or more highly plausible population principles. To many, such proofs establish not only a deep challenge for axiology, but also pose an important practical problem of how policymaking can confidently proceed without resolving any of the central questions of population ethics. Here we offer deflationary responses: first to the practical challenge, and then to the more fundamental challenge for axiology. Regarding the practical challenge, we provide an (...) overview of recent literature that explores the implications for public policy of the Repugnant Conclusion and related puzzles within population ethics, and shows that there is more commonality in the implications of different population axiologies than is generally recognized. The upshot is that uncertainty about population ethics presents no important problem for policymaking, and the importance of population ethics to policymaking has been overstated. We then turn to more fundamental issues about axiology, and describe a new series of formal proofs that undermine the idea that any plausible axiology could avoid the Repugnant Conclusion, including those that are assumed to avoid it in the literature. The philosophical upshot is that the Repugnant Conclusion cannot plausibly be avoided, and so it is a mistake to assume as a constraint on a plausible axiology that it must be avoided, as is assumed by most of the literature in population ethics, including by all of the fundamental impossibility theorems. Self-representational theories of consciousness hold that a mental phenomenon is conscious if, and only if, it presents, among other things, itself. But in conscious perception one may lose oneself in the object perceived and not be aware of one’s perceiving. The paper develops a Brentano-inspired response to this objection. He follows Aristotle in holding that one is aware of one’s perceiving only ‘on the side’: when one perceives something one’s perception neither is nor can become observation of itself. I argue (...) that the arguments Brentano gave for this claim in Psychology from an Empirical Standpoint are wanting. However, a promising argument emerges if one takes Brentano’s conception of noticing into account. (shrink)

This book scrutinizes recent work in phonological theory from the perspective of Chomskyan generative linguistics and argues that progress in the field depends on taking seriously the idea that phonology is best studied as a mental computational system derived from an innate base, phonological Universal Grammar. Two simple problems of phonological analysis provide a frame for a variety of topics throughout the book. The competence-performance distinction and markedness theory are both addressed in some detail, especially with reference to phonological acquisition. (...) Several aspects of Optimality Theory, including the use of Output-Output Correspondence, functionalist argumentation and dependence on typological justification are critiqued. The authors draw on their expertise in historical linguistics to argue that diachronic evidence is often mis-used to bolster phonological arguments, and they present a vision of the proper use of such evidence. Issues of general interest for cognitive scientists, such as whether categories are discrete and whether mental computation is probabilistic are also addressed. The book ends with concrete proposals to guide future phonological research.The breadth and depth of the discussion, ranging from details of current analyses to the philosophical underpinnings of linguistic science, is presented in a direct style with as little recourse to technical language as possible. Many people have been enraged lately by the enormous increases in certain generic prescription drugs. But free marketeers defend these prices by arguing that they simply represent what the market will bear, and in a capitalist society there is accordingly nothing wrong with charging them. This paper argues that such a defense is actually contrary to the very principles that free marketeers claim to embrace. These prices are not only unjust and exploitative, but government interference with them would not render (...) the market less free, at least if what it means for a market to be “free” is properly understood. Everyone, even free marketeers with a libertarian or neoliberal bent, should accordingly be against this kind of profiteering. (shrink)

In this chapter, Mark Budolfson and Dean Spears analyse the marginal effect of philanthropic donations. The core of their analysis is the observation that marginal good done per dollar donated is a product (in the mathematical sense) of several factors: change in good done per change in activity level of the charity in question, change in activity per change in the charity’s budget size, and change in budget size per change in the individual’s donation to the charity in question. They then discuss the “hidden zero problem” that some of the terms in the equation (in particular, the last term) might be “hidden zeros” that prevent donations from doing any good—or worse, imply that they do harm—even if the charity is at the top of effective altruism rankings based on the other factors. Values Education in Schools is a new resource for teachers involved in values and ethics education. It provides a range of 'practical philosophy' resources for secondary school teachers that can be used in English, religious education, citizenship, personal development and social science subjects. The materials include narratives to engage students in philosophical inquiry, doing ethics through the activity of philosophy, not simply learning about it.

In this paper, I explore the nature of social rules, including the limitations of most theories of rules which see them either as intentionally followed by, or as objectively describing the behavior of social actors. I argue that a phenomenological description of what it is like actually to be governed by a rule points the way to reconceptualizing the role of social rules in structuring our world and our experience of the world.

It is argued here that large-scale organization and networked computing enable new divisions of communicative work aimed at shaping the content, direction, and outcomes of societal conversations. The challenge for argumentation theory and practice lies in attending to these new divisions of communicative work in constituting contemporary argumentative realities. Goffman’s conceptualization of participation frameworks and production formats are applied to articulate the communicative work of organizations afforded by networked computing that invents and innovates argument in all of its senses—as product, (...) process, and procedure. Communicative work, however, may be scaffolding argumentative contexts and practices that are quite different than what has constituted past argumentative realities. The computerization of argument happens as organizations invent and innovate argument practice relative to the demands and opportunities of interorganizational communication. The cases and examples examined here suggest that argument practice is evolving around the logic of conversation and the principle of personalization. The analysis challenges argumentation theory to seriously engage with the construction of communicative contexts and the realization of ideas about disagreement management in organizational practice and information infrastructures. Directions for integrating insights from a design perspective on argument with insights from organizational and information systems theory are proposed for coming to terms with an era of large-scale organization and computerization, in particular the evolution of argument practice, the inscription of argument in the built environment, and the absorption of socio-cultural argument practices by organizations and computation. If ever there were a time in which concerns about equality as a primary issue for social policy disappeared from public view, now is not that time. Recent work in economics on inequality has climbed to the top of best-sellers lists, and the issue was a major talking point in American midterm elections in 2014. The sheer bewildering volume of scholarship and discussion of equality makes it difficult to distinguish signal from noise. What, of all that we know about ways (...) in which we are equal and ways in which we are unequal, matters? If, as seems plausible, we neither are nor should desire to be equal in every respect that we could in theory be equal, in which ways ought we to care about being equal? Does the kind of equality of outcome — perhaps equality of income or wealth — that is frequently the focus of discussion matter most? Does opportunity matter more? What about less material forms of equality such as equality of status, or power, or authority? How do these various forms of equality interact with each other? The essays in this volume represent the work of a number of leading scholars from different disciplines on these questions. Drawing on sources in philosophical analysis, empirical science, and history, they sort through competing claims and counterclaims about the intuitions that drive our concern for equality. Their conclusions are not in unison, but nonetheless represent important advances in our attempts to grapple with this crucial social value. (shrink)

Since the studies of Adolphe Quetelet, Franz von Liszt, and Cesare Lombroso, an empirical discourse has been established at the borders of statistics, criminology, and jurisprudence that sees in the dangerous individual a paradigmatic figure of the abnormal. Zola’s novel La bête humaine converges with this statistically induced criminology in at least three points: 1. in the reference to the complex of the dangerous individual; 2. in the assumption that all social processes have a reason in a fictitious figure; and (...) 3. in the detection of a danger area in which the social body is measured alongside a distribution scale of norm and defiance. These aspects point to the fact that a diffuse and dangerous force is working within the social body as well as within the body of the individual. All social relationships are pervaded by an energetics and a drive that functions automatically and out of reach of the will of the individual. (shrink)

“News! Oh! Yes, I always like news.” Throughout Emma, Jane Austen’s eponymous heroine repeatedly betrays her intense love of gossip. Other characters (notably, Miss Bates and Mr. Knightley) also indulge and rejoice in this style of conversation, as does the novel’s own narrator. In this chapter, the authors propose to examine the multifaceted and ambiguous role played by gossip in Emma, in light of the diverse opinions expressed by a number of critics and philosophers about the ethical and psychological significance (...) of this form of human discourse. They argue that Austen exhibits a fascinating, consistently ambivalent evaluative attitude toward the information-rich chitchat of her characters. She reveals a sensitivity to the moral dangers of gossip, as well as to what evolutionary psychologists have identified as its fundamental role in the regulation of human societies, and in the development of more indispensable forms of linguistic communication.
